Searching Kanawha County Criminal Dockets
Which tool you need depends on the court level. Begin at the West Virginia Judiciary court-record access page, the official hub for public searches. From there, WVPASS covers circuit records and MCRSearch covers magistrate records. A city ordinance case stays in municipal court. Later filings show a transfer or appeal. Federal charges run through PACER and the Southern District of West Virginia. They never touch either state portal.
- Read the notice, bond paper, citation, or case number to identify the court.
- For an Eighth Judicial Circuit matter, register for WVPASS and search by party name, case number, and available filters.
- For a Kanawha County Magistrate Court matter, pass the MCRSearch CAPTCHA and disclaimer, then search by name or case number.
- Open the matching entry and compare court, filing date, charge, and status before relying on it.
- Ask the Circuit Clerk or Magistrate Clerk for documents, certified copies, and any missing public entry.
Signing up for WVPASS costs nothing. MCRSearch needs no account. Even so, it returns no more than 30 results, so a broad name search in Kanawha County may require a case number or a call to the clerk. Neither portal replaces the clerk who keeps the original file.
Kanawha Felonies Change Dockets
A felony often starts in Kanawha County Magistrate Court. Magistrates take criminal complaints, set bail and bond, and hold preliminary felony examinations. If an indictment follows, the criminal docket moves to the Eighth Judicial Circuit. It then gets a circuit number. That circuit number and the magistrate number are not interchangeable.
The practical flow is: complaint and preliminary proceeding → possible indictment → circuit arraignment → motions and pretrial settings → plea or trial → disposition and sentence. Search MCRSearch first when the paperwork names Magistrate Court. Search WVPASS when an indictment, circuit notice, or circuit case number appears. If only one record is found, the clerk can confirm whether a second docket exists at the other level.
Inside a Kanawha Criminal Docket
A Kanawha County criminal docket is a dated log of court actions. West Virginia Trial Court Rule 15A.25 names the electronic register of actions the electronic docket. A search result can summarize the file. It may not show every document inside it. When precision matters, rely on the signed order.
| Case and court | The court-assigned number, Kanawha County, and circuit or magistrate level. |
|---|---|
| Charge | The offense text or statute shown by the court, which may change as the case moves. |
| Event | An arraignment, motion hearing, pretrial setting, trial, continuance, or other court act. |
| Plea and disposition | Separate fields for a plea and the case outcome; neither alone states the full sentence. |
| Order or sentence | The docketed ruling, sentence, bond, probation, or commitment entry where public. |
| Document status | Whether a filing is linked, unavailable online, sealed, confidential, or otherwise restricted. |
A filing date is not a hearing date, and a disposition is not always the sentence. For the official account, ask the clerk for the relevant order and a certification.
Kanawha Misdemeanor Search Limits
MCRSearch indexes Kanawha County Magistrate Court cases statewide. You can search by first name, last name, or case number. The launch material mentions company and citation-number options as well. A result may show a filing date, charge, disposition, and document list. MCRSearch does not download public documents.
The 30-result cap rewards exact details in a county this size. Check the spelling, county, and number format. Still nothing? Call the Kanawha County Magistrate Clerk at 304-357-0422. Or visit the counter at 111 Court Street in Charleston. The clerk provides copies. The clerk can also tell a failed search apart from a case that belongs in circuit or municipal court.
Note: A blank MCRSearch result is not proof of dismissal, sealing, expungement, or the absence of a case.
How a Kanawha Criminal Case Moves
The docket sequence changes with the charge and court, but common entries follow a recognizable path. Filing → arraignment → pretrial proceedings → plea or trial → disposition → sentencing. A continuance may add dates without ending the case. A motion may be filed well before the judge rules on it.
- Arraignment
- A court appearance at which the charge is addressed and a plea may be entered.
- Pretrial
- A setting used to manage motions, discovery, plea issues, and trial readiness.
- Disposition
- The recorded outcome of a charge or case, read with the court's order.
- Continuance
- An order moving a hearing or trial to a later date.
- Sentencing
- The stage when the court imposes a sentence after the relevant disposition.
WVPASS sends no case-update alerts. Recheck the criminal docket yourself, and confirm the next hearing with counsel or the clerk, especially after a continuance.
Kanawha Criminal Filings in 2025
The West Virginia Judiciary statistics program gathers its data from local clerks, and its annual reports are the authoritative source for completed-year totals. The 2025 Kanawha County circuit table lists 412 felonies, 16 magistrate appeals, 162 misdemeanors, and 189 other criminal cases. Add the circuit categories and you get 779.
The magistrate table adds 14 worthless-check cases and 87 juvenile cases. Charge tables use a different unit. One case can carry more than one charge row, so never add charge rows and call the total a count of unique Kanawha County criminal dockets. The online dashboard is preliminary. Annual reports remain the sound basis for year-to-year comparisons.
Courts That Hold Criminal Dockets
Kanawha County makes up the entire Eighth Judicial Circuit. Under West Virginia Code section 51-2-2, its Circuit Court holds general criminal jurisdiction. Magistrate Court handles limited criminal work: misdemeanors, preliminary felony proceedings, bail, and complaints. Municipal courts in Charleston, South Charleston, St. Albans, Dunbar, and Nitro keep their own dockets. Each covers ordinance and traffic cases.
| Court | Criminal docket role | Public route |
|---|---|---|
| Eighth Judicial Circuit | Felonies, circuit misdemeanors, appeals, and post-indictment proceedings | WVPASS and Circuit Clerk |
| Kanawha Magistrate Court | Misdemeanors, complaints, bonds, and preliminary felony work | MCRSearch and Magistrate Clerk |
| Municipal court | City ordinance and municipal traffic matters | The named city court |
| Federal district court | Federal offenses filed in the Charleston Division | PACER or federal clerk |
Let the court named on your current notice guide the search. A payment page is not the docket. And never force a city case number into a state portal.
Kanawha Bond and Payment Entries
The Kanawha Circuit Clerk handles bonds, restitution, and witness fees. State law sets a $25 criminal bond processing fee, except for a personal-recognizance bond. A $10 bail-piece fee applies too. Those figures are not the full amount a case may owe. Ask the clerk for the exact bond, refund, release, or payment record.
The Magistrate Court Payment System offers three lookup paths. They are Citation ID, Case ID, or Payment Plan ID. Matching is exact, and a citation search allows an optional county selection. The service charges $2 per payment. It finds payments; it is not a complete Kanawha County criminal docket.
Paying does not mean every charge is disposed or every bond condition has ended. Compare the receipt with MCRSearch and the clerk's record. A suspended-license release also stays separate from any action by the Division of Motor Vehicles.
Sealed Dockets and Public Access
Trial Court Rule 10.04 starts from openness. In Kanawha County, court writings and records are public. Another law or Rule 10.03 is the only exception. During business hours, anyone may ask to inspect records or get copies. You can request them in an electronic format too. The clerk may charge the actual cost of reproduction. Rule 15A.26 adds a duty for the circuit clerk. Make public electronic docket material available whenever it is not sealed or confidential.
Access boundary: WVPASS excludes sealed filings and juvenile cases from public search. Protected personal data and some domestic-violence or family material also remain confidential.
Contact the originating clerk for a missing public record. Do not try to reconstruct protected content from cached or third-party sources.
An expungement under section 61-11-26 is a real court process, not a quick delete button. The petition gets filed, served, and reviewed. Only then is anything sealed. So a case may vanish from a portal. That alone proves nothing about an expungement. The Kanawha County case lookup walks through both state search systems in more detail.
Kanawha Disposition and Sentence Records
On a docket, the disposition field records what happened to a charge or case at one point in time. The sentence or final order is different. It states what the court actually imposed. Dates can differ between the two entries. An amended order may change an earlier result, which is why a short MCRSearch result never tells the whole story.
Line up three things on a Kanawha County criminal docket: the disposition, the sentencing entry, and any linked order. Is the order not online? Request a plain or certified copy from the right clerk. Certification is the clerk's promise that the copy matches the official court record. Downloads from WVPASS, by contrast, are uncertified.
